Dealer terms
These terms apply when an approved dealer buys NETZSCH Racing parts from us to resell or fit. They apply with our Terms of sale. Where the two differ, these dealer terms apply.
Apply to be a dealer
In short
- Dealer accounts are by application and approval.
- Prices are FOB China, in Australian dollars, excluding GST and freight.
- Your discount tier depends on the total sets in one order request, and you can mix part numbers.
- An order request becomes an order when we confirm it with a pro-forma invoice. You pay in full before the goods leave the port.
- You arrange freight, insurance and import duties, unless we agree otherwise.
Becoming a dealer
Apply on the dealer page in our store with your business details. We review every application and may approve or decline it.
Once we approve you, your store account becomes a dealer account. If you have not registered yet, register with the same email address you applied with.
Dealer accounts are for businesses that resell or fit NETZSCH Racing parts. Keep your login within your own business.
Dealer prices
Dealer prices are FOB China, in Australian dollars (AUD), excluding GST, freight, insurance and import duties. Your dealer account can also show them in US dollars or euros. You pay in the currency on your pro-forma invoice.
Your prices are shown in your dealer account. They are confidential, so please do not share them.
We may change dealer prices. The prices on your pro-forma invoice apply to that order.
Volume tiers
Your discount depends on the total number of sets in one order request. Every line counts toward the total, so you can mix part numbers and formulas to reach a tier.
Your dealer account shows the tiers and their discounts, and how many more sets you need for the next tier. Tiers apply to each order request on its own: separate requests are not added together.
Order requests and pro-forma invoices
You send an order request from your dealer account. It is a request, not an order: it shows the prices and tier for the quantities you ask for.
We check stock and lead times, then confirm the order with a pro-forma invoice. The order is binding once you pay that invoice.
We may change or decline a request, for example if a part is unavailable. Any change is shown on the pro-forma invoice.
Once production has started, a confirmed order cannot be cancelled or changed unless we agree in writing.
Payment
Pay the pro-forma invoice in full, by bank transfer, quoting the invoice number, before the goods leave the port in China. Fees your bank charges are yours.
The goods belong to you once we have received full payment.
Freight, insurance and import
Unless we agree otherwise in writing, you arrange and pay for freight from the port in China, insurance, customs clearance, import duties and GST on import.
Risk passes to you when the goods are loaded on board at the port of shipment, as under FOB (Incoterms 2020).
Shipping Protection is not available on dealer orders.
Lead times
Most parts are made to order. NETZSCH pads usually leave the factory in about 5 working days. Large orders, discs and calipers can take longer. We give you the expected shipping date when we confirm your order.
Lead times are estimates. We tell you as soon as we know of a delay.
Checking your shipment
Check the goods when they arrive. Report shortages, wrong items or visible damage within 7 days, with photos and the packing list.
Correctly supplied goods cannot be returned.
Warranty claims
Your customers make warranty claims with you, as their seller. You then claim with us at support@netzschracing.com, with the details listed on our Warranty page: invoice number, part number, the car, photos and what happened.
If we accept a claim, we replace the part, or credit or refund what you paid for it.
Because you buy to resell or for business use, as far as the law allows our liability is limited to replacing the goods, supplying equivalent goods, or refunding or crediting the price paid, and we are not liable for lost profit, labour or other indirect loss. This does not affect rights that cannot be excluded under the Australian Consumer Law.
Selling NETZSCH Racing parts
You set your own resale prices. If we publish a minimum advertised price for a product, and the law where you sell allows it, you agree not to advertise that product below it.
Use our product information, photos and the NETZSCH Racing name only to sell genuine NETZSCH Racing parts. Do not change our product data or make claims beyond what we publish.
Ending dealer access
You can close your dealer account at any time by emailing us. We may suspend or withdraw dealer access by email, for example if these terms are not followed or our distribution arrangements change.
Orders we have already confirmed with a pro-forma invoice are still completed, unless we both agree otherwise.
Governing law
These dealer terms are governed by the laws of Queensland, Australia.
